Rules and Regulations - Trails At Chestnut Grove Homeowner's Association

The Board of Trails at Chestnut Grove has recently established Rules and Regulations for all members to follow. These Rules as well as our Enforcement Policy are attached hereto and will also be posted on the website. Rules and Regulations supplement the covenants and Bylaws and have been created to ensure that we all are able to enjoy our beautiful neighborhood and maintain and grow the values of our homes.
As such, we will begin enforcing these Rules effective immediately. Please know that our goal is to bring everyone into compliance and to remind you that each property is a reflection of the subdivision as a whole.
Homeowners should refer to subdivision COVENANTS and the BYLAWS of the HOA for various rules and regulations. In addition, we have received many complaints over the last several months. Listed below are some of the most common:
- Cars in the streets overnight - overnight street parking is not allowed.
- Garbage cans in sight - please store these where they CANNOT be seen. Do not store outdoors, in front of your house, on the side of your house, or in the back. They are an eyesore and dimmish the value of our community. Your neighbors see them.
- Construction debris and other items stored outside of your house or on your driveway for an extended period: The must be stored in your garage.
- Lights not properly maintained on outside posts. A working light post is required by the covenants and important for neighborhood safety. Homeowners must maintain light posts and promptly replace burnt bulbs in front yards (and back yards for lake lots). This is stipulated by the Covenants.
- Not picking up after your dog. Please respect your neighbors and our neighborhood.
- Modifications to your property without approval from the Architectural Committee: Must Fill out the approval forms and follow procedure BEFORE work begins on your project.
- Dead trees on property: Please replace dead trees or trim dead branches.
- Lawns must be weed-free, healthy and green, and properly maintained. Lawns must be mowed as needed and not allowed to be overgrown in order to maintain a uniform and tidy appearance throughout the community. Grass should be kept between 3 to 4 inches tall and and properly edged.
- EXPANDED EXPLANATION based on repeated requests for clarification, this paragraph was added: Clover, dandelions, crabgrass, nutsedge, and more are examples of what our neighborhood considers weeds. We do not consider them as grass. Proper lawns should be Kentucky Bluegrass or similar fine-leaved grass, suitable for lawns in high-end neighborhoods. Lawns should be manicured and green (fertilized, mowed, and edged to look neat). Clumps of cut grass are unsightly and must be removed promptly after mowing. Lawn clippings are a slip-and-fall hazard and must not be blown onto the sidewalk or the street. Dandelions spread profusely from yard to yard, and they expand in your own yard. Out of respect for your neighbors, please keep lawns weed-free, including empty lots. Dandelions spread from empty lots just as they spread from occupied lots. The HOA uses professional services to mow, weed and feed the common areas. Homeowners must do their part with their lawns to keep our neighborhood the pride of Champaign-Urbana. The HOA also replaces dead and diseased trees in the common areas. Homeowners must do their part to maintain trees in their own lots.
- Landscape beds must be weed-free, mulched, and properly maintained. Grass clippings are not acceptable as a mulching material.

Enforcement of Rules and Regulations of Trails at Chestnut Grove Homeowners Association
In order to maintain a safe environment as well as preserve property values and promote quality of life for its members, the Board of the Trails at Chestnut Grove Homeowners Association (“Association”) has instituted this policy to enforce compliance with the By-Laws, Covenants and Rules and Regulations of the Association.
When it comes to the attention of the Board that a homeowner has violated the established Rules and Regulations, Covenants or By-Laws of the Association, the homeowner will be notified in writing of the infraction and asked to correct it within a reasonable time period. If the violation is not corrected within such time frame, the Board will notify the homeowner that a reasonable fine will be assessed after an opportunity to be heard before the Board.
A Rules Enforcement Committee will be appointed by the Board and must consist of a minimum of three members. When a violation is confirmed, the Rules Enforcement Committee will review the violation and the circumstances involved and will determine the fine to be assessed. No single fine shall exceed $100; however, interest, fees for returned payments and conditions contained in the Trails at Chestnut Grove Homeowners Association Collection Policy will apply.
The failure of the Trails at Chestnut Grove Homeowners Association to enforce any of the Subdivision Covenants, By-Laws and Rules and Regulations of the Association shall in no event be deemed a waiver of the right to do so thereafter.
